Fred has certainly succeeded at one thing, here, and
that is to generate a lot of discussion on this topic.
I don't think anyone is opposed to the idea of
geocentric advertising. It actually makes sense -- in
exactly the same way that broadcast advertising is
split up between national and spot markets. If there is
a clear division between "two groups," it is by those
of us who would counsel caution to those who are ready
to flagrantly fly in the face of Federal copyright law.
Don't just do it because you "know" you're right and
that "advertising is NOT content." Do it because you've
consulted with an expert in the law, and his or her
legal counsel says you are safe to go for it. I'm
reminded of an article I read in the newspaper this
morning about a group of researchers who determined
that incompetent people had a much higher opinion of
their own abilities than was proven out in testing; and
that highly competent people were far more conservative
in their thinking about their own abilities. To
paraphrase Thomas Jefferson: the more you know, the
more you know you don't know.
