The answer depends on where you got the list of names
and email addresses. If these are all people who agreed
to receive unsolicited mailings then no, this isn't
spam. Now if this is a list you purchased from another
source then it could very well be spam.
Just counting the number of people who sent you back
email asking not to receive any more mails isn't a good
measure of whether this is spam. More people will
simply put a block on the sending email address rather
than sending an "opt-out" message. Sending that opt-out
message is dangerous because there are so many
unscrupulous email advertisers. Unfortunately, you have
no way of knowing how many people told their email
program to block you because of that mailing.
Yes, you can always find an ISP willing to send spam
(and I realize you do not consider what you did to be
spam).
I still believe the key is where you received your
names.
