Although not an American, I can answer your question.
That Bill was presented to Congress in 1998. It was NOT
passed. It is NOT law.
A similar Bill was presented subsequently, which is
also very commonly quoted in spams... Dubbed the
"Murkowski Bill", it, too, did not get passed and is
not law.
Spammers, being the unethical, dishonest, criminals
they are, are not deterred by the facts, and quote
these formerly proposed but failed Bills as an attempt
to justify themselves and deter the gullible from
lodging abuse reports with the spammer's service
providers.
Spam is still illegal under 47 USC section 227, the law
regulating fax abuse; that law has been used
successfully to fight spam. See the full text of the

My own website (now that I've bowed to the inevitable
and shut down my business due to spam-damage) is now
being rebuilt as an anti-spam resource... A large
section of it is operational, though I will be adding
additional pages with more resources, tips & helps in
the near future.
