I don't think buying a commercial email list for use can
be termed as Spam as long as people give their emails for
the purpose of selling, for instance, a business directory.

Recently I got to read that major businesses like Network
Solutions are selling their databases to whoever is willing
to pay for them. I'm not sure if this is legitimate, because
when I purchased my domain through Network Solution, or when
I gave my email to a company so that they could send me
information regarding their products/services, I didn't mean
it to be sold to a third and a fourth party. So if I begin
to receive solicitations from such sources, then it's Spam.
