The words intrusive, off topic, inappropriate and
misdirected all come to mind when thinking about top
text as an ad vehicle.
Most of the attempts to get people to download the
software programs I am familiar with use a
misrepresentative approach, e.g., promising one thing
while providing another.
Being associated with such a product does not offer
long or short term benefits to an advertiser in a world
of cheap key words, low CPMs, CPAs and search engine
optimizing.

But it's possible, although a stretch, that a good
prosecutor could build a case that the advertiser
together with the top text program provider are engaged
in an active conspiracy to steal copyrighted materials
and resell or reuse them for personal profit. Receiving
stolen property is just as much a crime as the theft
itself and paying to have something stolen is a bigger
crime.
That is aside from any monetary or equity damages in
civil liability that might be awarded by a judge or
jury who regard the practice as stealing.
