I don't know about the legal issues, but both of the big
for-pay newswires (http://www.businesswire.com,
http://www.prnewswire.com) will remove those references.
A few years ago, everyone started finding an excuse to
put MSFT in their press releases, in order to catch searches
for Microsoft information. Obviously, that degraded the
truly legitimate references. Even if you can get it past
the wire services, I believe journalists now recognize
it as a cheap gimmick.
So now the rule is: Unless they're involved in the release,
at at the very least a major subject of it, don't put 'em in.
