I agree with Jim Reardon and Mark Welch's evaluation
of the risks and downside of buying "opt-in" lists.
But let me throw open another angle for debate.

How does this apply to the sale of the publishing business,
rather than the list per se?

Say, for example, I own a motorbike website which includes
a confirmed opt-in mailing list alerting people to new
deals on bikes and parts from around the Web.

I then get an offer for the website from a publisher of
print motorbike magazines, who wishes to run both the site
and the mailing list as before (but who doesn't rule out
changes in scope or focus).

Where does this situation stand in terms of permission and
privacy?

I've been in this situation, and did not sell the mailing
list with the website, because I saw my promise not to sell
or pass-on subscribers' email addresses to a third party as
a genuine, all-inclusive one, one which precluded all
"but"s and "even if"s.

But I am curious as to the opinions of the list.
