Clearly there is a difference between turning off all images
and only turning off ads. This would be more akin to the
lawsuits against the VCR manufacturer who invented (but was
never able to sell) a VCR that paused recording when \
commercials came on and resumed recording when the commercial
ended.

Yes, it is up to the user to determine whether they want to
use it or not, but to invent and market whose only purpose is
to violate copyright laws is a whole other manner. Whether it
is free to view or not, the web page - as it is with ads and
all - is copyrighted by its owner. To tamper with that and
charge people to deliver the content to them in an altered way
violates the rights of the copyright holder in the page.
