Affiliate Marketing

A few questions about affiliate marketing.

Lets say a firm established an affiliate program with cj or linkshare.
Lets say that many website sign up to the program and a few of them are
actually spammers (which you do not know of). Can that be controlled ?
Lets say they use your link in their "daily" spam newsletter, maybe
having a big effect on your reputation. What can you do to stop that ?
