A good example of a similar name would be Vivendi and Vendisoftware.
Vendi being Latin.
The way I had it explained to me some time ago. Two companies, on in New
York, and one in Los Angeles, both are called "Joe's Plumbing". Both
have legal use of the name Joe's as both owners are named Joseph, or Joe
for short. Due to the fact that each services separate physical
locations, neither would be reasonably confused for the other.
In your case, your "service area" is worldwide, however, as your client
and the Canadian company are not in direct or indirect competition as
far as product/service, then the use of the name should remain valid for
each without recourse.
I am not an attorney, just a publisher that has been advised in domain
names. There is a Chatmag.org in Germany, that while involved in
Internet Chat, is not the same as my Chatmag.com, so as long as
Chatmag.org does not infringe on my primary mission, I can live with it.
Besides, most casual users subconsciously type .com, bringing them to me
anyway :)
