Your statements to the client are correct. I have been through various
domain name/trademark disputes in the past several years with various
companies like Ticketmaster. What it comes down to is: 1) do you compete
with this company in a similar market to any degree - geographically or
otherwise; 2) do they have a registered trademark; if so, what classes; do
these classes compete with your potential trademark? I would suggest your
client find an IP attorney who has dealt with similar issues to draft a
simple letter of response. In most cases, a simple and clear letter often
stops any potential threat.
