I'm curious if anyone has addressed the issue of
'false-positive' spam? The issue is that most users equate
nearly ALL email marketing as spam. They don't distinguish
between lists they may have opted in at some point in the
past or provided authorization to receive 3rd party emails
from the _real_ spam.

If this goes to legal battles, users might be surprised when
most of the legit mailing providers actually can provide
proof a user had provided permission. It may be list
exchanges with 20 or more different companies, but as long
as it goes to a source that can show "yes" to the email
permission or 3rd party questions, that's all they'll need.
The _real_ spammers will all move off-shore like Trinidad or
someplace.
