I tend to disagree, but in my opinion it doesn't really matter whether most
users would be surprised or not since such senders are not the type that
most users I know are concerned about. And to qualify my remark, I can
quanitify with high certainty that over 95% of the unwanted email I receive
is not even remotely permission-based and since I provide technical
consulting services including anti-spam solutions to numerous hosting
companies and ISPs I see consistent evidence that I'm not the exception to
the norm. That is why I don't think "legit mailing providers" are not a big
concern of most users.

Or were you really trying to suggest that most of what users consider to be
spam is in fact sent because they explicilty granted permission (or
implicitly did by failing to opt-out) at some point?
