The bill has 3 current threats aligned against it, any
of which could derail it before Jan.1, 2004. The
first is the DMA which is expected to attack the bill
on the lobbying front (federal) and in court if
necessary. The other 2 threats are from the federal
govenment. Any fed legislation on spam will nuke the
CA bill. However, it's uncertain/unlikely that the
fed will get this done before the end of this sessions
and thereby nullify the CA bill. Second is the
possibility that the fed amends the privacy bill that
was recently passed and had a specific override
provision to nuke the recent CA financial privacy
bill. The arguement would be that spam falls under
privacy. Seems as that the fed doesn't like CA
getting ahead on these issues.
