Non-disclosure is a good start. There is a firm of experts called Smart
and Biggar, http://www.smart-biggar.com that specialise in soft patents
like the one you are discussing. To be honest, you are best to ask them
this question as they are leaders in the field. They have successfully
enforced the patents of:

- sounds
- techniques/strategies
- open source software projects

Etc.
