This is a good question Cyndi. Unfortunately there is no easy answer.
Each state in the U.S. has its own laws, so there are many
jurisdictions to deal with. The arentfox.com/advertisinglaw.com web
site used to have an entire section with substantive articles devoted
to this topic, but when I went to look it up to refer you to it, I
found it had disappeared... probably because the laws have changed to
the point that the white papers which they had posted were no longer
entirely valid. I was still able to access some of the pages via
Google's cache however.
