You can't be accused for spamming by your ISP or web hosting company if
someone uses email forgery. Email forgery is very common and companies
are aware of that. If your ISP or web hosting provider gets a
compliant they will check IP numbers first and they will see that the
message has not been sent from their server so that you are not
a spammer.
That's why you have to see the header of the spammer's message.
There you can see important info about the sender. If you get
spammer's IP number go to http://www.dnsstuff.com and enter that IP
number. You will get the domain name and location of the spammer.
Usually you will see domain of his ISP and you should send an email
to abuse@...com with header of the message which is sent by spammer.
Usually they will sort this thing out very fast.
Also, you can get your Sender Policy Framework (SPF) key. It is
anti-forgery solution. You can get more info about SPF at
http://spf.pobox.com
There is also a DomainKeys solution for anti-forgery. You can get more
info about this solution at http://antispam.yahoo.com/domainkeys
