Re: Liabilities for the actions of your affiliates
Hi Cliff,
I think that, for an affiliate to market any email campaign, they should be
easily identifiable by the affiliate program sponsor/business.
I personally have been fighting spam emails as a response to the incredible
amount of spam I receive on a daily basis.
Despite changing email addresses, blocking domains, etc., I still receive
more than 300 spam emails a day.
I have tried to complain to the end business but their reply has been
(almost universally) that I had subscribed to the email subscription at one
point or another.
Explaining that the email address of mine in question is strictly a website
contact address that is not used to signup for anything else does not seem
to explain to them the spam.
I have found that ICANN will disable spam domains if any part of the owner's
contact information is incorrect and not corrected with 30 days of
notification.
Details in full can be seen here:

I have been able to have quite a few domains removed/blacklisted by ICANN
since I started my complaints to ICANN.
Of course, if the information is correct as to the owner, I make note of it,
keep copies of the email spam and wait... There will be a time when I can
sue effectively for the time the spam has cost me.
I have also been complaining to ICANN about domain registrars that allow
false information to be used when someone is purchasing a domain name.
I cannot take more than one cup of water out of the ocean every day. But I
feel better with every effort.
Thanks for letting me speak my mind.
