I'm not a lawyer, but I believe the unauthorized use of one's name in
advertising falls under another area of law - rights to publicity (or
something close to that.)
Deceptive advertising might also apply. A good attorney who specializes in
things like this would know. Unfortunately, though, if you're a small
business, the cost to sue is often more than you can ever actually recover
in damages.

But having an attorney send the appropriate nastigrams can sometimes take
care of situations without a terrible amount of expense.
