This type of thing actually happened with a web site I work with as a
writer and editor. Two people who used to supply content left to start
their own similar site. So far, no problem. But they put the name, and all
variations, of the old site, in their meta-tags. The original site is
called Tap Out Crew, and these words are not generic to the topic or
descriptions of the subject area, which is mixed martial arts competition.
So if you search for Tap Out, or Tap Out Crew, etc., they want their site
to come up. This caused a lot of controversy on mailing lists associated
with these sites. There may not be legal action because it may be more
hassle than it is worth, but IMHO it is very sleazy.
