The problem with this scenario is that, as a web content publisher, I
copyright all of my web site. Yes, the end user has the right to turn the
graphics off, in which case no impression is recorded and thus no
advertiser is billed for that user.

However, your scenario has the user's ISP *substituting their ads for
mine*. That means that they are actively altering my web page -- which is
piracy and copyright infringement, which is illegal.

And if I found out about it, that ISP would be toast. Yes, they can block
ads from loading, but if the load their own ads in that banner's
location, then they are pirating my web page, and they will be sued --
and not just by me, but probably by a huge number of other web content
publishers.

Think of it this way: the New York Times send 60 newspapers a day to
Joe's News Emporium. Joe then sells those copies of the Times to his
customers. But, what happens if Joe takes those copies of the Times and
super-glues ads that he has sold over the ads that appear in the Times.
That's essentially what your scenario has the ISP doing. And that's
illegal.
