As I write for Rolling Good Times On-line (a gambling news zine) I come
across stuff that may not reach everybody. One issue currently before
the Minnesota courts may be worth bringing to the list's attention in
relation to "Shop The Web" issues.

The State of Minnesota is running a case saying that Minnesota State law
applies to the World Wide Web. The nut of the case is that if you have
a web site and a few people from Minnesota go to your site you are
advertising in Minnesota and the full force of all of their laws applies
to you regardless where your web site is.

It is a tricky issue and the test case relates to a Sports Betting
company but it does raise some real curlers. This is from their opening
statement.

PERSONS OUTSIDE OF MINNESOTA WHO TRANSMIT INFORMATION
VIA THE INTERNET KNOWING THAT INFORMATION WILL BE
DISSEMINATED IN MINNESOTA ARE SUBJECT TO JURISDICTION IN
MINNESOTA COURTS FOR VIOLATIONS OF STATE CRIMINAL AND
CIVIL LAWS.

1. If you have a site marketing a product that is not approved of by
Minnasota and while you are asleep 250 people from Minessota log on to
your site you have commited a crime.

2. They have made it a crime for the individual to access gaming via
computer with the threat of confication of equipment for any citizen who
accesses a wed site they dissaprove of.

>From about the middle of the document there are some other examples of
court rulings on Web advertising.

Life on the Web for "Shop the Web" is going to get damn difficult if
every state and country start making different laws and holding site
owners liable for what their citizens do.
