included on your mailing list. We had a big problem when we didn't do this
during our first contest.

Checkbox, yes. Checked by default - BIG NO!!!

People who just don't happen to notice the checkbox (and there will be
plenty) will later accuse you of spamming them. And since they didn't make a
conscious decision to opt-in (i.e., were "tricked" into it), you will be
guilty of the same.
