This question was raised some time ago, but I thought the information
would still be of interest to some.

The following links to the summary of a judgement in the English courts
from last year in which Marks & Spencer plc sued One in a Million and
others for trademark infringement over the registration of domain names.

Although the decision is only valid in England and Wales the arguments
are still valid in other jurisdictions, particularly those that adhere
to the common law tradition (eg USA).
