I would argue that a domain name is significantly different
than piece of land. There are no trademarks at issue in
owning a prime piece of real estate. If Dell or Dow Jones
wanted to build on that land they would have to strike a
deal of go elsewhere. There is no "elsewhere" on the net -
domain names are singular and by technical definition unique
- it stops being an issue of location and becomes an issue
of property rights, and rights of this nature are protected
under trademark laws. If you can register and later sell
domains like surfcity.com or badass.com - that kind of
speculation would probably be viewed as acceptable by any
reasonable measure. But if you get into trademarks or
celebrity names you start down a slippery slope that will
surely end a court date - I'd be careful...
