you've missed a very important point.

a) the time of day and the method by which the telemarketer
calls you is *regulated*

b) the telemarketer is bearing at least a portion of the
cost of the pitch - spam is cost-shifting

c) the junk mail sender bears *all* the cost of the pitch
(well, as much as the gov't has deemed to allocate to them)

you're comparing apples with steak.
